New terms and conditions for logistics providers

The Logistics Terms and Conditions (Logistik-AGB) 2019, which were jointly revised by the German Association for Freight Forwarding and Logistics (DSLV), the Federal Association of Road Haulage, Logistics and Disposal (BGL) and the Federal Association of Furniture Forwarders and Logistics (AMO), with the cooperation of the Bremerhaven Institute for Logistic Law and Risk Management, will enter into force on 1 July 2019.

The new terms and conditions will replace the Logistik-AGB 2006 and supplement the Freight Forwarders’ Standard Terms and Conditions (ADSp) 2017.

Unfortunately, not all of the associations involved in negotiating the ADSp 2017 took part in revising the Logistik-AGB 2019.

Further, while the ADSp 2017 were jointly negotiated and recommended by shippers and service providers – including the Federation of German Industries, the Federation of German Wholesale, Foreign Trade and Services, the BGL, the AMO, the Federal Association of Transport and Logistics in Industry and Trade, the Association of German Chambers of Commerce and Industry, the DSLV and the Confederation of German Retail – the Logistik-AGB 2019 are recommended only by service providers.

Nevertheless, the revisionists’ aim was merely to update the Logistik-AGB in view of the ADSp 2017 and thereby avoid potential contradictions.
